It depends on complexity, which is why Highpoint Law quotes a flat fee up front rather than billing hourly — a straightforward single will costs less than a pair of mirror wills with a trust for young children. A BC notary can prepare a simple will, but cannot advise on a will where there is a blended family, a business interest, a trust, a disinherited child, or any real chance of the will being challenged under BC’s wills variation rules. Those situations need a lawyer.
Beyond drafting, an estate lawyer makes sure the will is validly signed and witnessed so it cannot be set aside, structures the estate to reduce tax and probate fees, and, after a death, handles the grant of probate and advises the executor on their legal duties.
Filing is usually a few weeks of preparation once the executor has the asset information together; the BC registry’s own processing time then varies, and the estate cannot be distributed until the grant is issued. Highpoint Law handles the filing and tells the executor what to expect at each stage.
